(BIVN) – A Hawaiʻi County panel on Friday denied an appeal of a subdivision approval in the Puʻukapu Homesteads area of Waimea.
The county Board of Appeals met in Hilo to hear the matter filed by Carol Adelkoff, who takes issue with the Planning Department’s May 2017 decision, saying prior drainage and flooding issues were not properly investigated before approval was granted. Adelkoff’s attorney told the board that “there’s very specific provisions of the subdivision code that are supposed to protect surrounding landowners when there is a flooding problem, so that their properties aren’t negatively impacted by a subdivision.”
Attorneys for both sides spent hours questioning testifiers, referring to photographs showing knee deep flooding on the property and marking up maps showing where structures are situated on the parcels.
The Board of Appeals ultimately denied the appeal.
